CONNEXPADEL TERMS & CONDITIONS

1. Terms and Conditions

These Terms and Conditions ("Terms of Use") govern the User’s access to and use of Connexpadel Website, hosted at https://www.connexpadel.com/, including any content, functionality, and services offered on or through the Website (hereinafter referred to as the “Website”).

By accessing the Website, you represent, warrant, and agree that:

I. You have the authority to access the Website;

II. You are at least eighteen (18) years old;

III. You agree to be bound by the present Terms of Use

VI. You will use the Website in accordance with these Terms of Use

Subject to these Terms of Use, the User is granted the right to access and use the Website solely for the following purposes:

- View information about the services provided;

- Register as a Coach for potential employment opportunities;

- Create a personal profile and allow Connexpadel to connect the User with padel Clubs for job opportunities;

- Register as a padel Club and allow Connexpadel to connect the User with padel Coaches to fill vacancies;

- Interact with Connexpadel through contact forms provided on the Website.

For the purposes of the present Terms of Use, “Users” shall mean any individual or legal entity accessing or using the Website.

2. Website Purpose and Services

Connexpadel is the platform that connects padel Coaches (“Coaches”) with international Clubs (“Clubs”). The Website is designed to bridge talent and opportunity, attract and recruit Coaches and identify matching job opportunities. Connexpadel undertakes the entire process so that Clubs and Coaches work with trust:

- Talent Search: finding qualified Coaches who fit your project;

- Job Promotion: we help your offer reach the right audience (Coaches);

- Easy Communication: direct contact facilitated, with our support;

- Offer Templates: we publish the offers for you;

- Visual Materials / Basic posts: support with posts when hiring the Coach.

Padel Clubs and sports centers can contact Connexpadel, provide information on the candidate profile they are searching for and the relevant job description. Connexpadel will analyze these and connect them with suitable candidates.

Connexpadel acts solely as an intermediary platform, facilitating connections between Coaches and Clubs, and reserves the right to introduce or modify fees for services at any time. Connexpadel is not a party to any employment contract, nor does it act as an employer, recruiter, or agent for either party. Users remain solely responsible for any decisions or agreements they enter into. Connexpadel is not responsible for verifying work permits, legal eligibility to work, licensing, or professional certifications.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities occurring under their account. Connexpadel reserves the right to conduct identity or credential verification checks; however, Connexpadel does not guarantee the accuracy or authenticity of any User information. Users agree to notify Connexpadel immediately of any unauthorized use of their account.

3. Disclaimer of Guarantees

Connexpadel does not guarantee that any Coach who registers on the platform will secure employment. While Connexpadel undertakes to use reasonable commercial efforts to identify suitable job opportunities for Coaches who provide the required information and support materials, no assurances are made regarding the timing or likelihood of job placement. Coaches remain responsible for supplying accurate and complete information as to their profile, level, experience and qualifications necessary to facilitate recruitment.

Likewise, Connexpadel does not guarantee that job vacancies posted by Clubs will be filled within any specific timeframe. Clubs remain responsible for supplying accurate and complete information, including the job description of the relevant job position necessary to facilitate recruitment. Any employment relationship shall be strictly between the hiring Club and the selected candidate.

Connexpadel will only enter into separate agreements with candidates where additional support services are expressly requested and provided.

For the avoidance of doubt, the Service Provider makes no warranty, express or implied as to the suitability and/or professional skills and level of any candidate. Connexpadel shall not be liable for any inaccuracies, omissions, or misrepresentations in User-provided information, nor for any acts, conduct, or performance of Coaches or Clubs once connected through the platform.

Users are solely responsible for ensuring that they hold all necessary qualifications, professional certifications, licenses, work permits, and legal eligibility required for employment or professional activity in any jurisdiction. Connexpadel does not verify Users’ legal employability or professional licensing unless expressly stated in writing and does not assume any liability arising from a User’s failure to comply with applicable laws.

4. No Employment, Agency, or Representation Relationship

Nothing in these Terms of Use shall be interpreted as creating any employment, partnership, agency, representation, joint venture, or fiduciary relationship between Connexpadel and any User. Connexpadel does not act as an employer, recruitment agency, representative, or agent for any Coach or Club, and does not enter into employment or service contracts on behalf of Users. Coaches and Clubs remain solely responsible for ensuring compliance with all applicable employment, labour, immigration, and regulatory requirements.

5. Communication Methods

Users agree that Connexpadel may contact them through any of the following methods for operational, informational, support, or legal purposes:

I. Email;

II. Telephone;

III. Messaging services such as WhatsApp or other communication platforms;

IV. Notifications displayed on the Website.

Users are responsible for ensuring that their contact information is accurate and up to date. Any notice sent to the most recent contact details provided by the User shall be deemed validly delivered.

6. Availability of Services

No Warranty of Continuous Availability: Connexpadel does not guarantee uninterrupted, secure, or error-free access to the Website. The Website may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond Connexpadel’s control. Connexpadel shall not be liable for any interruption, delay, suspension, or loss of access to the Website or Services.

7. Intellectual Property and Restrictions

All rights, title, and interest in and to the Connexpadel platform and the Website, including all content, software, source code, trademarks, trade names, service marks, logos, graphics, designs, and databases (collectively, the “IP Materials”), are and shall remain the exclusive property of Connexpadel and/or its licensors or partners and are protected by copyright, trademark, and other applicable intellectual property laws.

Except as expressly permitted by Connexpadel in writing, you shall not, directly or indirectly:

I. Reproduce, copy, modify, adapt, translate, publish, transmit, display, distribute, perform, or create derivative works of any IP Materials;

II. Use any robots, spiders, or similar data mining, data gathering or extraction tools or manual processes to collect, gather or copy any content or data in a manner not authorized by Connexpadel in writing;

III. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Website;

VI. Remove, obscure, or alter any proprietary notices or branding on the IP Materials;

V. Frame, screen or database scraping or mirror any portion of the Website in any manner.

No rights, licenses, or interests in the IP Materials are granted to any User except as explicitly set forth in these Terms of Use. Any unauthorized use may constitute a violation of applicable laws and Connexpadel reserves all its rights to initiate legal proceedings.

8. Acceptable Use and Restrictions

You agree to use the Website solely for lawful purposes and in a manner consistent with these Terms of Use. As a User you shall not:

I. Engage in any activity that could damage, disable, disrupt, impair, or compromise the Website or security systems;

II. Interfere with or restrict any other User’s access or use;

III. Impersonate any person or entity or misrepresent your affiliation;

IV. Attempt to gain unauthorized access to any systems, data, or accounts.

Users shall not attempt to solicit or engage other Users to enter into employment or cooperation arrangements outside the platform for the purpose of avoiding any applicable service fees (“circumvention”). Connexpadel reserves the right to suspend or terminate accounts engaging in such conduct.

The Users are responsible for ensuring that all information provided are accurate and lawful. Any breach of this Acceptable Use Policy may result in immediate suspension or termination of the User’s access.

9. Legal Disclosures and Ownership of Content

Connexpadel reserves the right to disclose, remove, or modify any content or information submitted or posted on the Website as necessary to comply with applicable laws, legal proceedings, regulatory obligations, or governmental requests, or at its sole discretion for any reason.

By submitting or uploading any content to the Website (“User Content”), you represent and warrant that you own or have lawful rights to such content and that such content does not infringe any thirdparty rights.

Unless otherwise explicitly agreed in writing, you hereby grant Connexpadel a perpetual, irrevocable, worldwide, royalty-free, fully transferable and sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such User Content for the operation, promotion, and improvement of the platform and related services.

The Users acknowledge and agree that no compensation shall be payable for Connexpadel’s use of User Content as permitted herein.

10. Limitation of Liability

To the maximum extent permitted by law, Connexpadel shall not be liable for any indirect, consequential, special, punitive, or exemplary damages, including loss of profits, opportunity, goodwill, or business interruption arising out of or related to the use of the Website. Connexpadel’s total aggregate liability for any claim shall not exceed EUR 100 or the total amount paid by the User for services in the 12 months preceding the claim, whichever is higher.

Nothing in these Terms of Use shall exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Consumers may have statutory rights under the laws of their country of residence which cannot be excluded.

11. Indemnity

You agree to indemnify, defend, and hold harmless Connexpadel, its directors, employees, and partners from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from your breach of these Terms of Use or misuse of the Website.

12. Termination Rights

Connexpadel may suspend or terminate any User account or access to the Website at any time, with or without notice, where such action is deemed necessary to protect the platform, other Users, or legal compliance.

13. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any dispute, controversy or claim arising out of or relating to these Terms of Use, shall be referred to and finally resolved by the Courts of the Republic of Cyprus which shall have exclusive jurisdiction.

14. Changes to these Terms & Conditions

These Terms of Use may be revised and/or updated from time to time, as needed due to changes in content, functionalities, services available on the Website, technical or business reasons, or as a result of legal and regulatory updates. All changes take effect immediately upon being posted and apply to all subsequent access and use of the Website. Continued use of the Website after changes have been implemented implies your acceptance. It is the User’s responsibility to review these Terms of Use regularly.
